This agreement is governed by the Civil Code, et seq. of Act No. 89/2012 Coll., specifically Section 1751, and following sections. It outlines the rights and responsibilities between the seller and a buyer who is an individual consumer.

1.2. Consumer Contracts

1.3. Governing Law and Terms

The following documents govern our rights and responsibilities:

If anything isn't covered by these documents, Czech law will apply. Specifically, the Civil Code and, if you're a consumer, the Consumer Protection Act.

If you live outside the Czech Republic, or if our relationship involves different countries, Czech law will still apply.

1.4. Your Agreement to These Terms

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

By placing an order and confirming that you've read these Terms and Conditions, you agree to them.

1.5. Purchase Channels

These Terms and Conditions shall likewise apply to orders placed through other remote communication channels (e.g., email or chat) and, with appropriate modifications, to orders made in person at a retail location or outside the seller's business premises. This includes, but is not limited to, orders described or finalized through the completion of a written order form or by direct purchase on-site, unless otherwise stipulated.

Invalid Provisions: If any part of these Terms becomes invalid, the rest of the Terms will still apply. We'll replace the invalid part with something as similar as possible.

Changes to the Terms: We may update these Terms from time to time. The version of the Terms that applies to you is the one that was in effect when you placed your order. Any changes to the Terms must be in writing.

2. PURCHASE CONTRACT

2.1. Placing an Order

Once you place an order and we confirm it by email, at that moment, a purchase contract is concluded between the Buyer and the Seller. This means you agree to pay the price for the goods, and we agree to deliver them to you. You become the owner of the goods as soon as you receive them, and you're responsible for them from that point on.

Please note that the Goods presented on the Website are of an illustrative nature only and do not in, and of themselves represent an offer from us to enter into a purchase contract pursuant to Section 1732, par. 2 of The Civil Code. This is due to the fact that the items we sell, particularly gemstones, are natural materials. This means that each item is unique, and variations in size, shape, color, structure, and pattern are to be expected. Similarly, display items in our showroom may differ slightly from the actual products.

2.2. How to Place an Order

You can place an order through our website or by using another method we allow (email, chat, store visit). Make sure your order includes all the information required in the order form.

The seller will provide the buyer with the same information with the final price (including taxes within the EU) before the contract is finalized, whether through other methods of remote communication (email) or during in-person interactions. Prior to submitting the order to the seller, the buyer has the opportunity to review and modify the details entered in the order, including the ability to correct any mistakes made during data entry. The purchase order summary is your final opportunity to review and make changes to any entered details.

The buyer submits the order to the seller by clicking the "order with obligation to pay" button. The seller considers the information provided in the order to be accurate. Upon receiving the order, the seller will promptly confirm receipt to the buyer via email, sent to the email address specified in the buyer's user account or in the order ("buyer's email address").

2.3. Placing a custom order

If the goods are not listed on the website and have to be manufactured or specially customized by the seller according to the buyer's specific requirements ("goods designed per the buyer's request"), the seller will confirm receipt of the order to the buyer via email and send a design proposal including the price to the buyer's email address. The contract is concluded only after mutual confirmation of the approval of the goods' design, price, and any additional terms regarding payment and the production process.

2.4. Cancelling or Changing an Order

You can cancel or change an order before we accept it by contacting us via phone or email. Once we accept your order, it is binding. We may agree to cancel or change the order, but in this case the decision is taken by us. If you cancel an order after we have started processing it (more details in clause 7), you may have to pay us for costs we have already incurred.

2.5. Order Confirmation

We will send you an email that we have received your order. Such information is sent automatically and does not constitute our acceptance of your purchase order.

A purchase contract is formed at the time you receive the ordered Goods.

2.6. Printed Copy of the Contract 

We will send you the contract documents by email. If you need a printed copy, we may charge you for the cost of postage.

We keep electronic copies of the contract, which are not accessible to third parties.

3. PRICE

3.1. Price Changes

Prices of goods and services stated on the web are inclusive of packaging, postage and applicable VAT rate. Urgent delivery costs will be charged in addition;

If the price listed for the Goods on the Website or during the ordering process is no longer valid, we will promptly inform you of the update. If we are unable to contact you, we will treat the order as cancelled. Any changes in price that occur after an order has been placed but before it has been accepted by us will not affect the order.

An individual price offer is valid for 2 weeks from the date of issuance.

In the event of a significant change in the wholesale price of the Goods due to exchange rate fluctuations and/or a price adjustment of the Goods (or their components) we reserve the right to modify the price of the Goods.

While we strive for accuracy, errors may occur. We review prices during order confirmation.

In the event that we made a completely obvious technical error when stating the price of the goods on the web interface or during the ordering process, we are not obliged to deliver the goods to you at this completely obvious incorrect price due to the appearance of our legal action pursuant to Section 552 of the Civil Code, or due to a mistake pursuant to Section 571 of the Civil Code.

3.2. Discounts

We run a number of promotions and discounts codes throughout the year at our discretion. Discount codes must be entered at checkout to apply. Any discount, e.g. obtained through a discount coupon (voucher), discount code, discount from a promotional event or competition, cannot be exchanged for money, exchanged or otherwise replaced. You can't usually combine discounts unless we specifically communicate otherwise on our website.

Custom-made products are not eligible for any discounts, such as those obtained through a discount coupon (voucher), promo code, promotional event, contest, or similar offers.

4. PAYMENT

4.1. Payment Methods

You can pay for your order using the following methods:

  • Credit or Debit Card (Visa, Master Card, Maestro): Before your order is shipped
  • Bank Transfer: Before your order is shipped (we will provide you with the bank details in the email conversation).

We use Stripe to process payments. By making a payment, you agree to the Stripe Terms of Service and Stripe Privacy Policy. Certain data, including your payment information, will be shared with Stripe to facilitate the transaction. We are not responsible for Stripe’s handling of payment processing.

4.2. Deposits

We require full or partial payment (at least 30% of the item's value) upfront in the case of the production of custom jewelry (based on individual requests).

Custom 3D visualizations require an additional fee of £150. This fee is non-refundable if you choose not to proceed with the final order. However, if the order is confirmed, the cost of the 3D visualization will be dedicated from the final price.

4.3. Invoices

You will receive the document (invoice) together with the goods. The document (invoice) is also considered a warranty certificate.

By agreeing to these Terms and Conditions, you consent to us issuing a tax invoice in accordance with Act No. 112/2016 Coll. We're required to issue this invoice and report your payment to the tax authorities online, or within 48 hours if there's a technical issue.

5. PRODUCTION TIME, DELIVERY AND IMPORT TAXES

5.1. Production

The goods proceed for the production after the payment of the full price or, if agreed upon by both parties, after the payment of a part of the price ("deposit").

We use our own materials for the production of goods.

Jewelry that is not in stock is usually created within 21 business days (4 weeks). Custom orders may take longer. We'll let you know the exact time.

Stock Items we always have in one piece, in one size and in one color of gold. If the ring size you have selected is significantly different from the stock item, a new item in the size you require will need to be made. If urgent production is required, the same general rules apply as for any urgent production not in stock jewelry.

You can pay an extra fee to have your jewelry made faster. This fee varies based on the item and can range from £100 to £150.

During peak periods, such as public holidays, promotional events, Black Friday, and the Christmas season, production time may exceed the estimated time frames provided above.

5.2. Delivery

All orders are sent via DHL Express tracked service.

Delivery of ordered custom jewellery is individual. We will inform you of its estimate.

You will receive a notification when your goods have been dispatched (a “Dispatch Notification”).

Once we physically deliver your order to you, we've fulfilled our part of the deal according to these Terms and Conditions. If you refuse the delivery without a valid reason, it's still considered delivered.

Please ensure that the contact information you provide (address, name, phone number) is accurate. We pass this information to the shipping company, and we're not responsible for verifying its correctness.

If we need to deliver the goods again or in a different way than originally specified in your order due to your actions, you will be responsible for covering the additional costs associated with the repeated or alternative delivery.

5.3. Delivery Time

Delivery time varies between 1 and 3 working days.

We can not control the delivery times of shipping companies. If you have any issues, please contact us, and we will work with the shipping company.

Changes made to orders after purchase may be subject to extended delivery to be confirmed at the time this change is requested.

During peak periods, such as public holidays, promotional events, Black Friday, and the Christmas season, delivery time may exceed the estimated time frames provided above.

5.4. Accepting the Goods

You are obliged to check the integrity of the packaging of the goods and the contents of the shipment (goods) when taking over from the carrier/delivery person, and in the event of any defects, immediately notify the carrier/delivery person. If the packaging is found to be damaged, indicating unauthorized entry into the shipment or damage to the shipment (goods), the buyer undertakes not to accept the shipment from the carrier/delivery agent.

All shipments are insured, so the carrier/delivery person is responsible for damage to the goods. Later complaints about mechanical damage to the goods caused during transport/delivery cannot be accepted.

Refusing a damaged package is not considered an unjustified refusal of the goods.

If you refuse delivery without a valid reason, we can charge you for delivery, storage, and other related costs.

Once you receive the goods (or if you refuse to accept them without a valid reason), you're responsible for any damage, loss, or destruction.

If we need to redeliver the goods or deliver them in a different way due to your actions, you'll be responsible for the additional costs.

5.5. Non-Delivery of Goods

If you have not received your goods within 2-4 working days of first receiving the Dispatch Notification you must inform us as soon as possible to our email: info@mialis.co.uk.

5.6. Import Taxes

UK Customers: There is a free trade agreement between UK and EU and you won’t be charged with Customs.Your order will be shipped from the Czech Republic and we bear any costs associated with VAT and other potential fees.

6. GIFT CARDS

6.1. How to Use a Gift Card

To redeem a gift card in electronic or paper form you must enter the unique numeric code from the card or email you received into the box that appears after clicking "Enter a discount code or redeem a gift card", which is located on the My Shopping Bag page, above the Checkout button.

6.2. Gift Card Restrictions

Gift cards can only be used once. Gift cards can be transferred to others. The person using the card has the same rights as the original purchaser. Gift cards have an expiration date. They cannot be used after this date. Gift cards cannot be exchanged for money.

7. RETURN AND REFUND POLICY

7.1. Return Policy

As a consumer, you have the right to return the Goods without providing any reason within 30 days from the date of receipt.

Please use our Return form to notify us of your intention to return the Goods. Please send the completed Return form along with the Goods to our mailing address or, alternatively, email the form to us and then send the Goods to our mailing address.

Be aware that the international certificate of authenticity, which may be sent with certain jewelry, as well as the box and the gift, are considered part of the Goods. If you decide to return the Goods, you are required to return the complete package set.

If you don't return these items, we may charge you a fee to replace them. The restoration cost is typically a minimum of £15, and the cost of obtaining a new certificate is a minimum of £60.

We suggest including the invoice (if available) or any other proof of purchase for the Goods when returning it.

7.2. Effects of Returning Goods

Returning the goods cancels the purchase contract, as if it never existed.

7.3. Receiving a Refund

We'll refund your payment within 14 days of you notifying us of your intent to return the goods. However, we won't initiate the refund until we receive the goods or proof of shipment.

We'll refund you using the payment account you provided us, unless you request a different method.

In the event that the return is initiated due to an error on our part or a warranty claim, we will cover the cost of return shipping. For all other returns initiated by the customer, the cost of return shipping is paid by the customer. Please note that these costs are non-refundable.

7.4. Damaged Returns

Please package the goods carefully to prevent damage during shipping. If the returned goods are damaged, scratched, or deteriorated, we may reduce your refund to account for the loss of value.

7.5. When Returns Are Not Possible

According to Section 1837 of the Civil Code, you cannot return goods and cancel the purchase contract in the following cases:

  • Customized Goods: Items that have been customized to your specific requirements, such as resized jewelry, engraved items, or non-standard ring sizes (which are not available on our website).
  • Gift Cards: Gift cards are considered a service, not a product. While you have a 30-day right to return them, this right is lost once you've used the card to purchase goods.
7.6. Our Right to Cancel

We may cancel the purchase contract in the following situations:

  • You haven't paid the full purchase price (or agreed deposit) on time.
  • You refuse to accept delivery of the goods.
  • We can't fulfill the order due to circumstances beyond our control (e.g., product discontinuation or supplier issues).

If we cancel the contract, we'll notify you immediately. If you've already paid, in full or in part, we'll refund you within 14 days (usually within 5 days) to the payment account you provided us. Please note that your bank may take 2-3 days to process the refund.

8. WARRANTY

8.1. Warranty

Your rights regarding defective goods are protected by law (specifically Sections 1914-1925, 2099-2117, and 2158-2174 of the Civil Code).

We are responsible, as the seller, that you receive the product you ordered in perfect condition, free from any manufacturing defects at the time of delivery. This means the product corresponds to the agreed description, type, and quantity, as well as quality, functionality, compatibility, interoperability, and other agreed-upon properties. The product is suitable for the purpose for which the buyer requires it and which the seller has agreed to, and is delivered with the agreed accessories and instructions for use, including assembly or installation manuals. The product complies with all applicable legal standards and is free from any legal defects, ensuring no third-party claims to the product and includes all necessary documentation for proper use.

We also guarantee that these conditions will be maintained throughout the warranty period.

Please ensure that the color of the goods (including the stone) may differ from the color displayed on the website due to the use of natural materials. Such a variation is not considered a defect in the product and does not warrant a complaint.

8.2. Warranty Claim process

If you discover a defect in your item, you can make a warranty claim. Here's how:

  1. Please inform us of the manufacturing defect by email info@mialis.co.uk or our phone call;
  2. Download and print the claim form from our website;
  3. Fill out the form with details like your order number, date of purchase, and a description of the defect;
  4. Choose how you'd like to receive a resolution: repair, replacement, or return.
  5. Submit the form by mail or email (info@mialis.co.uk).
  6. Carefully pack the item to ensure they remain undamaged. Send the package to our primary address in the Czech Republic.
  7. As soon as we receive your package and verify the manufacturing fault, we notify you of our conclusion.
  8. Once the claim is approved, we will resolve the issue and remove any defects as quickly as possible (within 30 days at the latest). You will be informed via email once the process is complete.

8.3. Lifetime Warranty

We offer a lifetime warranty against non-mechanical damage (material fatigue) for as long as you own the item. In such cases, we'll repair the item at no cost to you.

8.4. Warranty Coverage

The warranty covers material defects and demonstrable manufacturing defects.

The warranty does not cover mechanical damage (deformation caused by external force), damage to surface finishes (scratches), or damage resulting from improper use of the product.

The warranty is voided if any third party interferes with the product. For any request to modify or alter our product (e.g., resizing, polishing, restoring a matte finish, etc.), we kindly ask that you exclusively contact us.

Defects caused by incorrect or incomplete information provided by the customer in the order form are not recognized as valid grounds for a claim (we emphasize the importance of carefully measuring your ring size and thoroughly checking your order).

8.5. Rights under warranty

You have the right to:

  1. Request a replacement for any missing or incomplete product;
  2. Receive a discount on the purchase price if the product has a manufacturing defect at the time of receipt or if one arises during the warranty period;
  3. Exchange the product or its defective part if the defect cannot be repaired, provided that an exchange is a suitable solution based on the nature of the defect;
  4. If only a part of the product is defective, only the defective part will be exchanged;
  5. Products sold at a reduced price due to defects are not eligible for exchange;
  6. Free repair of the product. If the defect is determined to be irreparable, we will notify you promptly to explore alternative solutions;
  7. If we are unable to rectify the defect preventing the proper use of the product, or we cannot exchange the defective product (e.g. the product is no longer available), you can request a refund;

To exchange a product or receive a refund (withdrawal from the contract), the product must be returned in the condition you received it as outlined in section 7.1.

8.6. Warranty exclusions

Exclusions of common jewelry issues that are not covered by our warranty:

  • Discoloration caused by exposure to chemicals, makeup, swimming pools, hot tubs, or bathing;
  • Wear and tear of prongs and precious metals, which may require "building up" or restoration over time due to normal use.
  • Bent, damaged, or worn prongs resulting in stones falling out or being lost, caused by normal wear or other mechanical damage.
  • Lost stones or stones falling out due to chipping or breaking from mechanical damage.
  • Any repairs, modifications, or services performed by anyone other than Mialiscz s.r.o. will void the warranty.
  • Dents, nicks, and scratches from everyday wear are considered normal and are not classified as defects.
  • Tarnishing of metals over time is natural but can occur more rapidly if exposed to agents such as perfume, salty air, sulfur, skin creams, hairspray, chlorine, or acidic skin pH. The level of tarnishing depends on individual skin chemistry and jewelry care. Tarnishing due to these factors is not covered under the warranty.
8.7. Custom-made jewellery Warranty and Refunds

Custom-made items created specifically for you are covered under the same general warranty terms. However, personalized and customized products are not eligible for refunds.

Refunds will only be issued if the product is damaged, defective upon arrival, or significantly different from what was ordered. This does not affect your statutory rights. We are committed to ensuring the highest quality standards for our products, carefully inspecting each item before dispatch to minimize the likelihood of such issues.

  • Customized products: (items made according to the customer’s specifications or instructions).
  • Personalized products: (items engraved or customized per the customer’s request).
8.8. Jewelry Care

Fine jewelry can last a lifetime with proper care.

While gold and diamonds are highly durable, some gemstones and pearls are more delicate and susceptible to damage. Keep this in mind when wearing your jewelry during activities that could increase the risk of scratches or harm.

We especially recommend removing your jewelry when swimming, gardening, cooking, handling harsh chemicals, or engaging in sports.

9. Lifetime Care and Service Guarantee

We are proud to offer a lifetime warranty on our jewelry to ensure your pieces stay beautiful and well-maintained for years to come.

As part of our lifetime warranty, we provide the following complimentary services.

9.1. First Free Ring Resizing

We offer one free resizing for your ring to ensure a perfect fit after purchase.

Certain exceptions may apply:

  • Resizing is not possible in cases where it could compromise the structural integrity of the jewelry;
  • The service does not include adjustments to the width or thickness of the ring;
  • Limitations may apply to rings with pavé settings, side stones on the band; engravings, or intricate designs.

In situations where resizing is not feasible, the existing ring may need to be recycled, and a new one crafted.

This decision, along with any associated costs, will be assessed individually. Our team of specialists will evaluate each request to determine whether resizing is technically possible or if a new ring needs to be produced based on the specific design and other factors.

9.2. Annual Polishing and Cleaning

Once per year, we will professionally polish and clean your jewelry to restore its original brilliance.

9.3. Surface Refinishing

As part of our care services, we provide annual surface recovery to maintain the beauty and durability of your jewelry. This includes:

  1. Rhodium Plating for White gold 14K/18K;
  2. Black Rhodium Plating for all gold colors;

These services are designed to preserve the beauty and integrity of your jewelry.

Please note that any additional services or repairs outside the scope of our lifetime warranty may incur charges. For more information or assistance, feel free to contact our customer support team.

Before sending your jewelry to us, kindly reach out to us via email at info@mialis.co.uk to discuss your request and receive further instructions. This will ensure a smooth process and proper handling of your item.

10. ADDITIONAL INFORMATION FOR CONSUMERS

10.1. Business Authorizations

We operate under a valid business license. No other licenses are required for our activities.

10.2. Complaints

If you have a complaint, please contact us via email at info@mialis.co.uk. You can also file a complaint with the relevant business license office or the Czech Trade Inspection Authority.

For issues related to hallmarks and precious metal testing under Act No. 539/1992 Coll., please contact the government Assay Office.

10.3. Consumer Dispute Resolution

If you're a consumer and have a dispute with us that we can't resolve together, you can file a complaint with the Czech Trade Inspection Authority:

These options offer out-of-court dispute resolution. You have one year from the date you first raised the issue with us to file a complaint with these organizations.

You can also use the European Commission's online platform to file a complaint about goods purchased from us and find alternative dispute resolution entities.

11. WEBSITE REGISTRATION

11.1. Account Creation

You can create a user account by registering on our website. Please keep your login information confidential. We're not responsible for unauthorized use of your account.

By registering, you consent to the processing of your personal data. Please ensure that the information you provide is accurate and complete. We may terminate accounts created with false or incomplete information. If your information changes, please update your account promptly.

11.2. Purpose of the User Account

Your user account allows you to order goods and manage your account settings.

11.3. Account Termination

We reserve the right to terminate your account without notice if you violate our Terms and Conditions or engage in unethical or illegal behavior.

11.4. Privacy Policy

We take your privacy seriously. We will handle all personal data provided by you in accordance with Act No. 110/2019 Coll., on the processing of personal data, as amended (hereinafter referred to as the “Act on the Processing of Personal Data”) and in connection with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

You may not use, copy, or distribute this content without our permission or the permission of the copyright holder. Our products, including custom-made items, are also protected by copyright. You can't copy or sell them without our consent.

We reserve the right to make similar items in the future, even if they're based on a custom order, unless we agree otherwise with the customer.

12.2. Liability and Website Use

We are not responsible for errors caused by third-party interference or misuse of the website. When using the website, please avoid actions that could disrupt its functionality or overload the system.

If you engage in illegal or unethical behavior while using the website, we may restrict, suspend, or terminate your access without compensation. You may also be liable for any damages caused by your actions.

FINAL PROVISIONS

These general terms and conditions are governed by and interpreted in accordance with the legal system of the Czech Republic.

Any provisions of these terms and conditions declared unlawful, invalid or otherwise unenforceable due to the laws of the countries in which these general terms and conditions are to apply will not be taken into account. All other provisions of the general terms and conditions remain fully valid, binding and enforceable.

The contractual relations between the seller and the buyer in these terms and conditions, not otherwise specified, are governed by the applicable legal regulations of the Czech Republic, in particular the Civil Code and Act No. 634/1992 Coll., on Consumer Protection, as amended. If the legal relationship established by the purchase contract contains an international (foreign) element, then the parties agree that the relationship is governed by Czech law.

By sending the order, the buyer agrees to these terms and conditions in the wording that is stated on the web portal of the online stores on the day the order is sent.

The seller reserves the right to make changes to any provisions of its general terms and conditions at any time by publishing them on the web interface of the online stores. If the buyer or user of the web interface of the online stores does not agree with these terms and conditions, he must immediately stop using these websites or stop shopping at the seller's online stores.

Both parties undertake to resolve any disputes that arise between the seller and the buyer primarily by means of conciliation. If a dispute arises between the buyer as a consumer and the seller that cannot be resolved amicably, the buyer has the right to refer the dispute to the Czech Trade Inspection Authority (address: Czech Trade Inspection Authority, Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2; www.coi.cz, www.adr.coi.cz; e-mail: adr@coi.cz; phone: +420 296 366 360). Any disputes between the seller and the buyer that cannot be resolved (or will not be resolved) amicably or through the Czech Trade Inspection Authority will be resolved exclusively before the relevant Czech courts.
